Terms of Service

Effective August 14, 2026. These terms govern your use of JP’s Photo Shack (the “Service”), a browser-based layered photo editor.

1. Agreement

By opening, using, or exporting from the Service you agree to these Terms and the Privacy Policy below. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

JP’s Photo Shack is an online photo editor. You can create canvases, import images, paint, type, crop, remove backgrounds, adjust color, work in layers, and export PNG or JPG files. Features may change, break, or be withdrawn at any time. The Service is provided for personal and commercial creative work, not as a guaranteed professional lab, archive, or backup.

3. Your content

You keep all rights you already have in photos, text, and projects you bring into or create with the Service (“Your Content”). We do not claim ownership of Your Content. You grant us a limited, revocable license to process Your Content only as needed to run the editor in your session (display, composite, filter, export, and temporary local storage you choose to use).

You are solely responsible for Your Content. You represent that you own it or have all licenses, consents, and permissions needed to import, edit, and export it, including model, property, and copyright clearances.

4. Intellectual property of others

Do not import, edit, or export material that infringes someone else’s copyright, trademark, publicity, or privacy rights. Removing a background, cropping a watermark, or applying filters does not make a third-party image yours. If you receive a takedown notice about work you exported, you must handle it. We may disable access if we receive a valid complaint.

5. Acceptable use

You may not use the Service to:

  • create or process child sexual abuse material or any sexual content involving minors
  • create non-consensual intimate imagery or deepfakes intended to harm, defraud, or impersonate
  • violate export, privacy, or criminal law
  • attack, scrape, or reverse engineer the Service in a way that harms other users
  • upload malware or attempt to disrupt the editor

We may refuse or terminate access for any of the above.

6. No archive, no professional warranty

The editor runs in your browser. Projects saved locally can be lost if you clear site data, switch devices, or the browser storage fails. Export files you care about. We do not warrant that background removal, color correction, or any filter is accurate, complete, or suitable for print, press, medical, forensic, or legal use. Preview colors can differ from printed or calibrated output.

7. Accounts and sign-in

Sign-in, if offered, is optional and may be provided by a third-party identity service. You are responsible for activity under your account. We may suspend accounts that violate these Terms.

8. Third-party material

Fonts, sample photos, and linked services belong to their owners and are used under their licenses. Sample images are for trying the editor, not for unrestricted commercial reuse unless a license says otherwise.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant uninterrupted, secure, or error-free operation, or that exports will be free of artifacts or data loss.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JP’S PHOTO SHACK AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST IMAGES, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) TWENTY-FIVE U.S. DOLLARS ($25). Some places do not allow these limits; they apply only to the extent allowed.

11. Indemnity

You will defend and indemnify JP’s Photo Shack and its operators from claims, damages, and costs (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, or your breach of these Terms, including intellectual-property and publicity claims.

12. Changes and termination

We may update these Terms. Continued use after an update means you accept the new Terms. We may stop offering the Service at any time. You may stop using it at any time. Sections on content, disclaimers, liability, and indemnity survive.

13. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Courts located in Florida have exclusive jurisdiction, except that we may seek injunctive relief anywhere. If a provision is unenforceable, the rest remains in effect.

14. Contact

Questions about these Terms: use the in-product Help menu or the contact method published with the Service. These Terms are the entire agreement between you and us about the Service.

Privacy Policy

Effective August 14, 2026.

What we process

Photo Shack is built to edit in the browser. Images you import, paint, and export are processed on your device for compositing and filters. Projects you choose to save may be stored in this browser’s local storage (IndexedDB) or as a file you download. We do not sell your photos.

What may leave your device

If you sign in, the identity provider receives the data needed to authenticate you. If you export or save a file, that file lives wherever you put it. Standard server logs (IP address, user agent, request time) may be collected to keep the site up. We do not use your photos to train public AI models.

Cookies and local data

The editor uses local storage and similar technologies to remember projects and session state. You can clear them with your browser settings; doing so deletes locally saved work.

Children

The Service is not directed at children under 13, and we do not knowingly collect personal information from them.

Your choices

Export your work, delete local projects, or stop using the Service at any time. For sign-in data, use the identity provider’s account tools.

Changes

We may update this policy. The effective date above will change when we do.
